Well, its happened again. I was contacted by a potential client that hired a lawyer to handle a personal injury case, the lawyer malpracticed the case and, surprise surprise, the lawyer doesn't have any insurance. The client's personal injury case was a good one and the lawyer simply didn't know the time limitations on filing the suit. It's forever lost. So, in my opinion, the lawyer has stolen the value of that case from his client. And, to top it all off, the lawyer's failure to carry insurance adds insult to injury.
Why does the Kentucky Bar Association, or any state's bar association for that matter, not make legal malpractice insurance MANDATORY? At the very least, make lawyers disclose to clients that they don't have any insurance. At least that way the client can make an informed decision about whether this is the lawyer they want to hire.
Based on this article from 2008 and
this article from 2006 only Oregon, has made legal malpractice insurance mandatory. About 22 other states have made lawyers disclose whether they carry insurance or not--but sometimes they only have to disclose to the Bar, not clients. Worthless.
So, what's the deal Kentucky? Are we going to let lawyers continue to represent people without being financially responsible when they malpractice, or are we going to continue to allow them to have a license to steal?

( i know its like year? which will be dec. but i just read all files recently...????att told me he would put info and tell all thigns i was concerned with to help my case and he did not!)is this possible?time running out and i am in dire need! please someone help me>?
I had a work injury in 2003,was terminated approx 4 weeks weeks later. My case was dismissed in dec 2008. I want to reopen on grounds that i was badly represented i was not allowed to tell things. i wanted to tell to show my credibility and hopefully show you how they did indeed do me wrong. i did get injury and suffer from it and what they have done to me.... My attorney was suppose to help me, speak for me he really did nothing. He did not even try. i had to constantly remind and send emails asking when things will be done.... with ample amount of time of course. Everything judge put in decision i tried to get att to cover. I sent many emails and to him and his secretary! I did not realize i was being totally ignored.... i was told because thye dont answer dont mean hes not working on it. There are mistakes in paper work and medical records. Although they gave different reason to fire me if you read all my paperwork file, and listen ... etc... you will see this is not case. At will or not, they LIED! I was kept from medical care for too long. I believe my civil right were violated! I trusted my att to know better. They even have things in decision about me receiving money (ttd) i never got.money i owe for trips to hearings.. etc... I told att this he ignored me would say, it dont matter bla bla ba....he talked over me and would not listen....made me beleive he knew waht he was doing and knew best...in these things but what i said did not seem to matter...? MY att would not bring it up and made me look like liar in this judges decision. He said its all irrelevant but judge mentioned it in his decision. I have been seeing therapist since 2006 over my injury and being fired for it........and all it cost me. and i cannot forget about it. ( again, att. would not allow me to submitt (he knew what he was doing)?cost me my life in my eyes. I know 5 yrs is up on suing for being fired, by krs standards?(he cost me that too) but even if i can prove they did that part would help and hope it will help my credibility, my honesty. But workers comp i do deserve.. and should still get. and should be allowed to reopen and possibly file complaint on me att? Had tingling fingers before i got this job went to dr.etc.. the tingling went away after exercises and slow down on typing. (which i was new too and doing it alot) although they offered possible surgery that may or may not help and can make it worse? the job and their att.and dr. says my injury had nothing to do with what i go through with my hand now and all along. They says it not feasible... I have had this pain and problems since i got hurt. it did do something. please take look at the rest of my explanation.... and please please help me reopen this case? it says in krs i can unders certain circumstances? mistakes etc..? well there many mistakes. MY att. also did and said nothing to defend me when they came up with things, documents, never asked me about stuff never tried to see if i had any say or proof! i look like fool...... with att out of cracker jack box.. i hate to say that but???and attorney pretending(not literally) to be one..... did not do his best for me....( i just read all this in file)if all att work this way i feel sorry for the people! Also my attorney told me we cannot appeal because it was dismissed in its entirety. I was told wrong by my attorney! (possible legal malpractice?)i emailed labor board workers comp specialist and they said thats too late to appeal but possible to reopen? but to hurry! and to get an att. thank you and i will be waiting for your response for the rest of the story! I do have my work file, termination, appeals,etc..medical reports,attorney file etc. on the way... our dr gave impairment rating.. thiers did not. please ask for the rest of the story... before you decide if your bit curious at all? ALSO i am interested in ss-ssi case???waiting last appeal i believe but do not have att. as most say it aat appeal counsel level and nothing anyone can do til decision is made? or legal malpractice case?judge did nto have all facts to but guess that wa my att fault???if i knew i had to be there to open my mouth i did not need att?I NEED SOMEONE TO BELIEVE IN ME AND HELP ME PROVE THIS!!!!!!!!!!!!!!! god help me.
