Driving While Eating a Hashbrown

A man was pulled over by police accused of driving while holding his cell phone, which carried a $300 fine.  He insisted the office mistook the McDonald’s hash brown he was eating for a cell phone and refused to pay the fine, taking the case to trial.  A judge found him not guilty, ruling the state failed to meet its burden of proof.  The judge made no ruling on whether or not he was truly eating a hash brown as he claimed.
